Terms of service

1. Who these terms are with

The Shoothill AI Trust Index (the “Service”) is operated by Shoothill Ltd, a company registered in England and Wales with company number 5885234, registered office at the address shown on shoothill.com. By creating an account or otherwise using the Service you agree to these terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation.

2. What the Service does

The Service runs an independent benchmark suite against frontier AI models on an hourly schedule and publishes the resulting Trust Index score, per-pillar scores, and other indicators. Account holders can configure watchlists, alerts, and digests. Some features (currently the Compare Models feature) may be offered as paid upgrades; pricing and inclusions are shown in the Service at the point of upgrade.

3. Your account

You are responsible for keeping your account credentials secure and for everything done under your account. Tell us immediately if you believe your account has been compromised. We may suspend or terminate an account that has been used in breach of these terms.

4. Acceptable use

You agree not to:

  • access the Service by automated means, scrape it, or attempt to circumvent rate limits;
  • resell, sublicense, or rebrand the Service or its data without our written agreement;
  • use the Service to harm Shoothill, the AI providers we benchmark, or other users;
  • upload prompts or content that are unlawful, infringe third-party rights, or contain personal data about people who have not consented to your sharing it;
  • probe, scan, or attempt to compromise the integrity of the Service.

5. Benchmark data and intellectual property

The Trust Index methodology, scoring weights, test catalogue, branding, and the Service’s code are owned by Shoothill Ltd. While the Service is free to use you may view and reference Trust Index scores in your own work with appropriate attribution to “Shoothill AI Trust Index”. You may not redistribute the underlying scoring data in bulk, present it as your own benchmark, or imply endorsement by Shoothill of any particular AI model.

Content you submit (prompts, contact form messages, model requests) remains yours. You grant Shoothill a non-exclusive licence to process that content as needed to provide the Service.

6. AI provider responses

Benchmark scores describe model behaviour against our test catalogue at the time of measurement. Models change continuously and a high score is not a guarantee of correctness for any specific use. The Service is not a substitute for your own evaluation of an AI model for a particular task. We take no responsibility for the content of responses generated by third-party AI providers via the Compare Models feature; those responses are governed by the relevant provider’s terms.

7. Service availability and changes

We aim to keep the Service available but do not guarantee uninterrupted operation. We may add, remove, or change features at any time, including suspending the Service for maintenance. The benchmark methodology may also evolve; material changes will be reflected in the Methodology page.

8. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Shoothill disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud).

9. Limitation of liability

To the fullest extent permitted by law, Shoothill’s total liability arising out of or in connection with the Service is capped at the greater of (a) the fees you paid to Shoothill for the Service in the twelve months before the event giving rise to the claim, or (b) one hundred pounds sterling (£100). We are not liable for indirect, incidental, special, or consequential damages, or for any loss of profit, revenue, data, or business opportunity.

10. Termination

You can stop using the Service and delete your account at any time. We can terminate or suspend your access if you breach these terms or use the Service in a way we reasonably believe poses a risk to it, to other users, or to Shoothill. On termination, sections that by their nature should survive (3 to 9, and 11 to 12) continue to apply.

11. Governing law and jurisdiction

These terms and any dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that we may bring proceedings for an injunction in any jurisdiction where infringement of our intellectual property occurs.

12. Changes and contact

We may update these terms from time to time. The “last updated” date at the top of this page will reflect the most recent change. Continued use of the Service after a change means you accept the updated terms. Questions or concerns: email webenquiry@shoothill.com.
